Turtles in Upstate New York?

So im planning on getting my friend a turtle for her birthday. May 14th. But some people are saying they don't sell turtles in New York anymore. And other people are saying the shell has to be 4 inches wide. And im in Upstate New York. So what are the laws. Yes i am looking around too
